By accessing, browsing, or making a purchase through fertyl.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"), as well as our Privacy Policy, Returns and Exchanges Policy, and other published policies. If you do not agree with any of these provisions, you must refrain from using the Site.
The Site is operated by Epic Enterprises LLC, a company registered in the State of Florida, United States of America, which markets products under the Fertyl Health brand in Mexico and other markets. All purchases made through the Site are subject to these Terms, regardless of the country from which the user accesses it.
1. Use of the Site.
Access to and use of the Site is permitted only to individuals over 18 years of age with full legal capacity to enter into contracts under the applicable laws of their country of residence.
You agree to:
● Use the Site lawfully, ethically, and in accordance with these Terms.
● Provide truthful, current, and complete information when making a purchase or creating an account.
● Refrain from any activities that could compromise the security, availability, or integrity of the Site or third parties.

2. Nature of the Products.
Fertyl Health markets dietary supplements focused on women's and men's wellness, including fertility, reproductive health, menstrual cycle, intimate health, menopause, and male vitality. The information published on the Site—including product descriptions, educational articles, and marketing materials—is for informational purposes only and does not constitute medical advice, diagnosis, or treatment.
Our products are not intended to diagnose, treat, cure, or prevent any disease, unless expressly stated otherwise and they have received the corresponding regulatory authorization from COFEPRIS or the competent authority.
It is recommended to consult a healthcare professional before starting any supplement, especially in the case of:

● Pre-existing medical conditions.
● Concomitant use of prescription medications.
● Known allergies to any of the ingredients.
3. Quality and Manufacturing Standards.
Fertyl Health products are manufactured under Good Manufacturing Practices (GMP) in certified facilities. Some products are manufactured in facilities registered with the U.S. FDA.
Reference to facilities registered with the FDA or other authorities does not imply evaluation, approval, or endorsement by said authorities regarding the efficacy or safety of the products for any therapeutic indication.
4. Individual Results.
The results obtained from using dietary supplements and wellness products can vary significantly from person to person. Factors such as age, genetics, overall health, diet, lifestyle, consistency, and duration of use influence the results achieved.
Fertyl Health does not guarantee specific results. Customer testimonials and reviews reflect individual experiences and are not representative of typical results.
5. Prices, Availability, and Orders.
All prices published on the Site are subject to change without notice and may be expressed in the currency indicated at the time of purchase. We reserve the right to correct typographical, pricing, or inventory errors.
Receipt of an order confirmation does not constitute final acceptance of the order. Fertyl Health may cancel orders in the following cases:
● Obvious errors in pricing or inventory availability.
● Incorrect or incomplete contact or shipping information.
● Inability to contact the customer to verify necessary information.
● Well-founded suspicion of fraud or unusual activity.
In case of cancellation, a full refund will be issued to the original payment method used.
6. Payment Methods.
We accept the payment methods enabled on the Site at the time of purchase, which may include credit or debit cards, Mercado Pago, PayPal, Shop Pay, or other platforms available depending on the region.
Fertyl Health does not store complete bank card information. Payment data is processed directly by payment providers certified under PCI-DSS standards. Fertyl Health does not have access to users' confidential financial data.
7. Shipping.
The published delivery times are estimates and may vary depending on the recipient's location, product availability, the selected shipping service, and circumstances beyond our control (day holidays, weather-related issues, customs delays).

8. Exchanges, Returns, and Refunds.
The conditions applicable to exchanges, returns, and refunds are detailed in our Exchange and Return Policy, which forms an integral part of these Terms. By making a purchase, the customer agrees to these conditions.
9. User Accounts and Subscriptions.
Certain services or benefits on the Site may require the creation of an account. You are responsible for maintaining the confidentiality of your credentials and for all activities carried out through your account.
If products are offered via a subscription model, the frequency and amount of charges will be clearly stated during the checkout process. Customers may cancel their subscription by following the procedure indicated on the Site or by contacting the customer service team.
10. Intellectual Property.
All content available on the Site—including text, images, photographs, logos, trademarks, designs, videos, graphics, and other materials—is the property of Epic Enterprises LLC (operating under the Fertyl Health brand) or its respective owners, and is protected by applicable intellectual property laws in Mexico and the United States.
Reproduction, distribution, modification, reverse engineering, or unauthorized use of any content on the Site is prohibited without prior, express written authorization.
11. Reviews and User-Generated Content.
Users may share opinions, comments, or reviews regarding products and services. By posting content, the user declares that such content is truthful, does not infringe upon the rights of third parties, and that they possess the necessary rights to share it.
Fertyl Health may use reviews and testimonials for informational, promotional, or advertising purposes, with or without identifying the author. We reserve the right to moderate, edit, or remove content that violates these Terms, is offensive, or is unlawful.
12. Limitation of Liability.
To the maximum extent permitted by applicable law, Epic Enterprises LLC and the Fertyl Health brand, along with their officers, employees, partners, and suppliers, shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from:
● The use or inability to use the Site or the products purchased.
● Errors, omissions, interruptions, or delays in the availability of the Site.
● Results derived from the use of the products that differ from expectations.
● Unauthorized access to user information by third parties beyond our control.
In no event shall the company's maximum liability to the customer exceed the amount paid for the order that gave rise to the claim.
13. Third-Party Sites.
The Site may contain links to external sites or services operated by third parties (payment platforms, social networks, sales platforms). Fertyl Health does not control and is not responsible for the content, privacy policies, or practices of such sites. Accessing these links is at the user's own risk.

These Terms are governed by the laws applicable in Mexico regarding transactions carried out within that territory. Any dispute arising from the use of the Site or the products sold shall be submitted, in the first instance, to direct negotiation between the parties. If unresolved, the parties shall submit to the jurisdiction of the competent courts in accordance with applicable law.
To the extent that Mexican consumer protection laws (PROFECO) grant additional rights to consumers residing in Mexico, such rights shall prevail over any conflicting provision in these Terms.
